Terms for participating in Neurapix Giveaways on Instagram
1. Scope of application
These conditions apply to the giveaways organised by neurapix UG, Am Feuerschanzengraben 10, 37083 Göttingen (hereinafter “neurapix”). By participating, each participant accepts these conditions of participation.
This competition is in no way associated with Instagram. It is in no way supported or organised by Instagram and does not constitute a legal claim against Instagram. All information within the scope of this competition is provided exclusively by neurapix.
2.1 Any person who is at least 18 years of age and is acting on their own behalf is eligible to participate.
2.2 neurapix reserves the right to exclude persons who violate these conditions of participation or attempt to gain advantages over other participants by improperly influencing the competition.
2.3 Participation is only possible within the time limit specified in the competition description. Each participant may only take part once in an identical competition.
3. Conduct of the competition
3.1 The requirements for participation in the competition are stated directly in the competition description. The respective deadline for participation is also stated there. All participants in the competition who meet the entry requirements within the entry period will be considered. After expiry of the entry period, the winner will be drawn at random.
3.2 Cash payment of the prize is excluded. The prize is not transferable.
4. Prize processing
The winner will be notified of his/her prize by e-mail or other electronic message. A prerequisite for the receipt of the prize is that the notified participant informs neurapix within one month of the notification being sent whether he/she accepts the prize. If neurapix does not receive a corresponding message within this period, the prize is forfeited and neurapix carries out a new draw among the remaining participants.
5. Liability for defects
Neurapix shall only be liable for damages incurred by the winner due to material and/or legal defects in the case of malice, intent or gross negligence. Otherwise, liability due to material defects and/or defects of title is excluded.
6. premature termination, adjustment or change of the competition
Neurapix is entitled to prematurely terminate, adapt or modify the competition at any time without stating reasons, if a proper implementation of the competition cannot be guaranteed without these measures for technical or legal reasons.
7. Applicable law
The law of the Federal Republic of Germany shall apply to all legal relationships between the parties.
8. Data protection
Responsible for data processing in connection with the competition is:

The named controller is jointly responsible for the data processing on the Instagram page via which the competition is organised, together with Instagram (platform operator is Meta Platforms Ireland Limited, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2 Ireland) within the meaning of Art. 26 GDPR.
8.1 Processing of your personal data in the context of the competition
We process your personal data for the proper implementation and execution of the competition and in particular for the transfer of the prize.
In order to carry out the competition, the profile name and, if available, the first and last name of the respective participant are collected and stored. The data will not be passed on to third parties beyond this.
The legal basis for this processing of your personal data is Art. 6 para. 1 lit. b GDPR (implementation of pre-contractual measures and fulfilment of a contract).
If we publish the first name and surname of the winner(s) separately on our profile or announce them externally, for example on our website, this will only be done with the prior, express consent of the winner(s) in accordance with Art. 6 para. 1 lit. a GDPR.
8.2 Storage period
After the end of the competition, your processed personal data will be deleted no later than two months after the end of the competition, unless there is effective consent for further processing (e.g. with regard to the sending of newsletters) and/or there is no continued legitimate interest on our part in further storage.

If you object, we will no longer process your personal data unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms or are necessary for the establishment, exercise or defence of legal claims.
Your objection does not require any special form and can be sent to us by e-mail.
